Competition Law

The practice of competition law in Canada falls into two broad but distinct categories: advisory work and litigation. The advisory category includes advice on the competition law implications of a variety of business activities including advice on such matters as mergers, cartels, abuse of dominance and other reviewable matters, marketing and distribution, and compliance. Commercial lawyers represent public authorities as well as the private sector, in all facets of procurement, including preparing and responding to requests for proposals and tenders, developing selection criteria, advising on selection of successful respondents and preparing and negotiating contract documentation.

Telecommunications law includes a wide range of activities referrable to the regulated sectors of telecommunications, broadcasting and broadcast distribution. Telecommunications practitioners advise companies whose activities are regulated directly by the CRTC and/or Industry Canada, as well as other companies whose activities might be affected by agency and department decisions. Communications practitioners tend to focus on licensing activity before the CRTC.

Advertising and Marketing Law

The practice of Advertising and Marketing Law includes the review of promotional materials relating to contests, promotions and other such offers; advertising copy review including television, radio and print ads to ensure that all required agreements/documents are prepared; advising with respect to the marketing, advertising, packaging and labelling of all types of products including food, drugs, cosmetics and medical devices; and preparation of marketing and advertising related agreements such as sponsorship, distributorship, merchandising and licensing agreements.

Commercial Arbitration

Commercial Arbitration involves advising as to contractual provisions for arbitration and ADR, advising as to appropriate arbitration rules and procedures, and conducting arbitrations. As an alternative to litigation, international commercial arbitration cuts across almost every area of law and business activity.

Directors' & Officers' Liability

Directors' & Officers' Liability practice comprises the provision of advice and representation, whether by way of counsel, negotiation, judicial proceedings, or various forms of alternative dispute resolution, to corporations, directors, officers, and insurers on director and officer liability, indemnity and insurance options, corporate governance obligations and risk management strategies.
