Description:

This webinar will provide an introduction to, and overview of, the prevalence and consequences of 'predatory marriages' in Canada, how such marriages affect vulnerable and incapable older adults, and common law principles affecting this emerging issue.

 

Predatory marriages result when an unscrupulous opportunist, who, purely for financial gain, marries a person with limited or compromised capacity or cognition. Predatory marriages are a form of exploitation and abuse of older adults. These marriages occur when one party to the marriage is incapable of understanding, appreciating, and formulating a choice to marry. Given that marriage brings with it a wide range of property and financial entitlements, perpetrators of such marriages have much to gain and the vulnerable older adults have much to lose when preyed upon in this fashion.

1.     Absorption, Distribution and Elimination of Alcohol - understanding the pharmacokinetics (what the body does to a drug) of alcohol is important for the medicolegal professional.  Various aspects such as the effect of food or a warm drink on absorption, can you speed up the rate of elimination of alcohol, the effect of gender, does the use of hand sanitizer cause a positive BAC, and the effect of liver disease on the elimination of alcohol will be covered.

2.     Principles of retrograde extrapolation of BAC in drinking drivers - the controversial issue of RE will be explained by applying the known pharmacokinetics of alcohol to the drinking driver.  The last drink or drink-after (hip-flask) defence will be discussed.  Is RE scientifically valid?

3.     Blood alcohol testing - is the most frequent method of determining BACs after breath alcohol testing.  The hospital and forensic alcohol tests will be compared.  The effect of the use of an alcohol swab, clotting, storage at room temperature and the use of preservatives on BAC will be presented.

In Part 2, we will discuss the public policy and international implications of these increased disclosure requirements for the sound prediction test.  Public policy should demand predictability of the patent system so that a patent filed according to the law 15 years ago should not be invalidated by changes in that law now.  Furthermore, these new disclosure requirements substantively change what is required in a patent application in Canada as compared to the rest of the world.  Canada is a signatory to TRIPS and NAFTA, which were designed to harmonize patent applications around the world.  By requiring additional elements in order to meet the test for sound prediction (as well as sufficiency and s. 53), Canada is arguably not abiding by these treaties.
