Description

The book examines all facets of the law of trusts in every jurisdiction of Canada, including the nature of trusts under common law and civil law, and some international jurisdictions such as the United States, where Canadian trust law is increasingly relevant in estate planning. You will gain insight into the creation and administration of express trusts; trust termination; conflict of laws, including the Hague Convention on the Recognition of Trusts; the variety of uses to which the trust is applied; and the law concerning remedial trusts (for example, resulting and constructive trusts), especially in matrimonial law.
About the Author
Donovan W.M. Waters, B.C.L., M.A., D.C.L., LL.D., Ph.D., is a leading international expert in trust law and the author of several texts, including the definitive Canadian text ,i>Waters' Law of Trusts in Canada. He has had a distinguished academic career, which has included positions at the Universities of Oxford, London, Chicago, Saskatchewan, Montreal and Victoria. In addition, Dr. Waters has acted as legal counsel in relation to the establishment, operation and regulation of a variety of domestic and offshore trust structures created for private and commercial purposes. He is regularly called upon to provide legal counsel in the context of litigation involving all manner of fiduciary relationships and equitable remedies. He is Chair of the B.C. Law Institute's Trustee Act Modernization Committee, and is a frequent speaker and author of numerous papers, articles and books.
Mark Gillen has been a professor with the Faculty of Law, University of Victoria, since 1987. His primary areas of research are trust law, corporate law and securities law. He is the author of Securities Regulation in Canada (Carswell), as well as co-author of Corporations Principles and Policies and co-author and editor of Corporations and Partnerships: Canada. He has written numerous articles on the convergence of securities laws and implications for developing securities markets. In collaboration with three other American and Canadian legal practitioners, Prof. Gillen also published a report comparing Canadian and American antitrust laws.
Lionel Smith, B. Sc., LL.B., LL.M., D. Phil., LL.B. (civil law) is James McGill Professor of Law and Director of the Paul-André Crépeau Centre for Private and Comparative Law at McGill University. In addition to the law of trusts, his research interests include unjust enrichment, comparative law, and company and commercial law. He is a member of the International Academy of Comparative Law, the American Law Institute, the European Law Institute, the International Academy of Estate and Trust Law and the Bar of Alberta.
