This is the third permanent supplement to The Annotated Refugee Convention: Fifty Years of North American Jurisprudence. This book provides a collection of summaries relating to various articles of the 1951 Convention Relating to the Status of Refugees including the complex definition of a Convention refugee, the cessation clauses, the exclusion clauses, various treaty rights of refugees under the Convention (such as the right to a travel document, right to be naturalized, right to access to the Courts), the protection against refoulement, the criteria for expulsion of Convention refugees on the grounds of criminality or threats to national security and the extra-territorial applicability of the Convention.
The case law is organized by topic, making the relevant decisions easily accessible. There is systematic coverage of the case law interpreting the series of elements that must be examined in assessing a claim to Convention Refugee status. The third supplement continues the practice of providing detailed Canadian and United States of America case law annotations on timely and in depth topics. It provides detailed coverage of the period between January 2007 and August 2008, but includes a few important Canadian cases decided up to and including December 2008. This edition includes over 450 new case law annotations. Highlights include:
• Khadr v. Canada (2008) 2 S.C.R. 125 • Amnesty International Canada v. Minister of National Defence ( A-149-08, December 17, 2008, Desjardins, J.A.) • M.C.I. v. Patel (FC IMM-2482-07, June 17, 2008, Lagacé, J.) • Key v. M.C.I. (FC IMM-5923-06, July 4, 2008, Barnes, J.) • Jayasekara v. M.C.I. (A-140-08, December 17, 2008 FCA)
