This book examines the interrelationship between Internet domain names and trade-mark, with a particular focus on Canada. Commencing with a review of the Canadian law of trade-mark in the context of domain name disputes, the acquisition and infringement of trade-mark, the author considers this law in the Internet, substantive issues involved in enforcement of trade-mark, jurisdictional and procedural issues, as well as the remedies available. It contains extensive discussion of international legislative developments, particularly for those topics where there is little or no Canadian jurisprudence.
The following are reviewed and considered: • The United States’ Anticybersquatting Consumer Protection Act (ACPA) • The Uniform Dispute Resolution Policy (UDRP) • CIRA Domain Name Dispute Resolution Policy (CDRP) • CIRA Domain Name Dispute Resolution Rules (Rules).
